OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID IN QUEBEC AND WHERE PROHIBITED OR RESTRICTED BY LAW.

By entering the Microsoft “Final Fantasy XIV” Promotion (“Promotion”) you (or, if you are a minor/not the age of majority in your place of residence, your parent or legal guardian on your behalf) agree to abide by all terms and conditions referenced in these Official Rules.

1) ELIGIBILITY: This Promotion is only open to legal residents who physically reside in the fifty (50) United States (including District of Columbia) (“US Resident”) or Mexico (“Mexican Resident”) who are 18 years of age or older, and legal residents of Canada (excluding Quebec) who have reached the age of majority in their province or territory of residence (“Canadian Resident”) at the time of entry. Employees of Microsoft Corporation (“Microsoft”) (“Sponsor”), Square Enix Holdings Co., Ltd., GMR Marketing LLC (“GMR”), and any promotion or other vendor agency involved in this Promotion (and any other person engaged to work on this Promotion) and each of the above’s respective affiliates (collectively, the “Released Parties”) and the household and immediate family members (defined for the purposes of this Promotion as a parent, spouse, child, and sibling) of such employees are not eligible to enter or win. Promotion is subject to all federal, state, provincial, territorial, municipal, and local laws and regulations. Void in Quebec and where prohibited or restricted by law.

2) TIMING: This Promotion begins at 12:01 a.m. Pacific Time (“PT”) on March 14, 2024 and ends at 11:59 p.m. PT on March 28, 2024 (“Promotion Period”).

3) HOW TO ENTER:

a) To enter via X (formerly Twitter), you must (1) create a new account or use an existing account on www.twitter.com (“X”); (2) follow either the @Xbox X handle at https://twitter.com/Xbox if you are a US Resident, the @XboxMexico X handle at https://twitter.com/XboxMexico if you are a Mexican Resident, or the @XboxCanada X handle at https://twitter.com/XboxCanada if you are a Canadian Resident; (3) follow the @FF_XIV_EN X handle at https://twitter.com/FF_XIV_EN; and (4) repost one (1) of the Sponsor’s designated promotional posts containing “#XboxFFXIVSweepstakes” (a “Repost”) during the Promotion Period. Reposts must be in the EXACT form as the original post to be eligible to receive one (1) entry into the Promotion.

i) X Entry Criteria and Terms: Reposts must be made by the authorized X account holder at the time of entry. “Authorized X account holder” is deemed as the natural person who is assigned to the X address from which the entry was received. Reposts must be posted by the close of the Promotion Period to be eligible to be included in the random draw. If your X account is private, your Repost will NOT be eligible; you must change the setting on your account from private to “public” or “unprotected” for your Repost to be considered an eligible entry. You must have a valid X account and agree to the X Terms of Use and the X Privacy Policy in order to be eligible to enter. Registration on X must be completed before an entry may be submitted. X membership is free. The X platform will be the official time clock for the Promotion X Reposts. All attempts at email or any other Internet method of entry excluding X are void. Reposts that contain information that is deemed to be lewd or profane; contain material that violates or infringes on another’s rights, including privacy, publicity, or intellectual property; material that is hateful or defamatory; material that promotes bigotry, racism, or harm against a group or individual or promotes discrimination; or material that is unlawful or in violation of or contrary to federal or state/provincial/territorial/municipal laws or regulations, will be disqualified as determined solely by Sponsor. Sponsor reserves the right to review any or all Reposts in its sole discretion. Reposts containing such prohibited content and/or otherwise deemed by Sponsor, in its sole discretion, to be inappropriate will be disqualified. Sponsor makes the final determination as to what Reposts are eligible to take part in the Promotion. By entering via a Repost, each entrant warrants that the Repost is created by the entrant and grants Sponsor, to the maximum extent permitted by law, the perpetual, unlimited and irrevocable right to post, publish, adapt, edit, make derivative works, and/or otherwise use the Repost in any manner, including copyright, and in any media now known or hereafter developed.

b) Entry Limit: Limit one (1) entry per person/authorized X account holder. The use of automated devices to enter this Promotion is prohibited. The Released Parties and X Corp., assume no responsibility for lost, late, or misdirected entries or any computer, online, telephone, or technical malfunctions that may occur. All entries become Sponsor’s property and will not be returned.

4) WINNER SELECTION/PRIZE: On or around March 29, 2024, GMR will randomly select one (1) potential Grand Prize winner from among all eligible entries received during the Promotion Period. All random drawings will be conducted in New Berlin, Wisconsin, United States under the supervision of a designated representative of the Sponsor, whose decisions are final. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period.

a) One (1) Grand Prize: One (1) custom-designed “Final Fantasy XIV” Xbox Series X console bundle (NON-FUNCTIONAL, TO BE USED AS AN ART PIECE) (design elements and all other aspects of the custom console are at the sole discretion of the Sponsor), one (1) Xbox Series X console bundle (console model, features, design and all other aspects of the console are at the sole discretion of the Sponsor), one (1) “Final Fantasy XIV” Online Complete Collector’s Edition for Xbox Series X/S,  and one (1) 12-month Xbox Game Pass Ultimate Membership.

b) The Approximate Retail Value (“ARV”) of the Grand Prize is $1,319.93 USD/$1,783.87 CAD/$22,529.20 MXN.

For the purposes of these Official Rules, the ARV of any prize is estimated at the beginning of the Promotion Period. The ARV for such prizes is subject to variances and fluctuations in the consumer marketplace between the date the ARV is estimated and the date the prize is awarded; there will be no cash or other compensation awarded for any valuation differences.

Xbox Game Pass Ultimate Memberships must be redeemed at microsoft.com/redeem. Credit card required. Unless you cancel, you will be charged the then-current regular membership rate when the promotional period ends. Limit: 1 per person/account. Subject to the Microsoft Services Agreement, Game Pass terms and system requirements at: xbox.com/subscriptionterms. Upon redemption eligible existing gaming membership(s) will upgrade to Ultimate at a conversion ratio.

Except for applicable manufacturer’s limited warranties and any rights you may have under your local laws, prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including any implied warranty of merchantability or fitness for a particular purpose); you assume the entire risk of quality and performance, and should the prize prove defective, you assume the entire cost of all necessary servicing or repair. Microsoft’s limited warranty terms can be found here: https://support.microsoft.com/warranty.

Any difference between the stated approximate retail value and the actual value of the prize will not be awarded. The prize is not transferable, or redeemable for cash, and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion.

Any and all taxes related to a prize are solely the responsibility of the winner and Sponsor will comply with U.S. tax reporting requirements. The winner is advised to seek independent counsel regarding the tax implications of accepting a prize. All other expenses not specified as part of the prize description are solely the winner’s responsibility.

AWARD OF THE PRIZE TO THE POTENTIAL WINNER MAY BE SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO SPONSOR ALL DOCUMENTATION REQUESTED BY SPONSOR TO PERMIT IT TO COMPLY WITH ALL APPLICABLE FEDERAL, STATE, PROVINCIAL, TERRITORIAL, LOCAL OR OTHER TAX REPORTING LAW OR REGULATIONS IN THE UNITED STATES OR ELSEWHERE. TO THE EXTENT PERMITTED BY LAW, ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. Refusal by any entrant to submit such documentation or complete any required forms or obligations shall result in such winner forfeiting the prize.

5) WINNER: The winner will be notified and confirmed as follows:

a) Grand Prize Winner: The potential Grand Prize winner will be notified on or about April 2, 2024 via X direct message from @Xbox (for US Residents), @XboxMexico (for Mexican residents), or @XboxCanada (for Canadian Residents) to the potential Grand Prize winner’s X account used to enter. The potential Grand Prize Winner will have one hundred twenty (120) hours from the time the direct message was deployed to respond to the direct message with their first and last names, country, daytime phone number, and email address. Within two (2) business days of receipt of the potential Grand Prize winner’s response, the potential Grand Prize winner will then be contacted via phone or email to the phone number or email address provided by the potential Grand Prize winner and will be required to respond within twenty-four (24) hours of notification to verify eligibility and provide a shipping address (no P.O. Boxes accepted).

i) U.S. Winner Confirmation Process: In order for a U.S. Resident to be declared the Grand Prize winner, they must complete, sign, and return the presented affidavit of eligibility, mutually acceptable liability release, and publicity release, and the presented U.S. Department of Treasury Internal Revenue Service W-9 form (the “US Documents”) via Proof.com within seven (7) calendar days of delivery of the US Documents, or the Grand Prize will be forfeited in its entirety.

ii) Canadian Winner Confirmation Process: In order for a Canadian resident to be declared the Grand Prize winner, they must first correctly answer a time-limited mathematical skill-testing question unaided and without mechanical or other assistance, and have complied in full with these Official Rules. The skill-testing question will be administered by phone/email within one hundred and twenty (120) hours of initial notification of selection. In addition, in order for a Canadian resident to be declared the Grand Prize winner, they must complete, sign and return the presented U.S. Department of Treasury Internal Revenue Service W-8 BEN form, and the declaration of eligibility, mutually acceptable liability release, and publicity release (the “Canadian Documents”) online via Adobe Sign within seven (7) calendar days of presentation of the Canadian Documents, or the Grand Prize will be forfeited in its entirety.

iii) Mexican Winner Confirmation Process: In order for a Mexican Resident to be declared a Grand Prize winner, they must complete, sign, and return the presented U.S. Department of Treasury Internal Revenue Service W-8 BEN form (the “Mexican Documents”) online via Adobe Sign within seven (7) calendar days of presentation of the Mexican Documents, or the Grand Prize will be forfeited in its entirety.

Within two (2) business days after receipt of the executed US Documents/Canadian Documents/Mexican Documents, Sponsor/GMR will notify the potential Grand Prize winner of their winner status via email or phone.

b) Prize Fulfillment: The Grand Prize will be shipped within approximately eight (8) weeks following winner confirmation to the address provided by the winner. Return of any prize/prize notification as undeliverable or failure to accept any prize within the specified time period may result in disqualification and forfeiture of the prize. If notified winner is not eligible, forfeits prize, or declines prize, or is unsuccessful in answering the mathematical skill-testing question (applicable to potential winner from Canada only) an alternate winner may be randomly selected as the Grand Prize winner, time and circumstances permitting. Five (5) attempts to award the prize will be made. After these attempts, any unclaimed prize will remain unawarded.

c) Publicity Release: Winner further grants to Microsoft and its affiliates the right to use and publish their first name, last name initial, and country of residence online, in print, and in any other media in connection with the Promotion. Acceptance of a prize constitutes permission for Sponsor to use winner’s name and likeness for advertising and promotional purposes without notice, review, approval or additional compensation unless prohibited by law.

6) ADDITIONAL TERMS: By entering, entrant (or, if you are a minor/not the age of majority in your place of residence, your parent or legal guardian on your behalf) agrees to accept and

abide by the Official Rules of this Promotion and agrees that any dispute with regard to the conduct of this Promotion, rule interpretation, or award of prize, shall be resolved by Sponsor, whose decision shall be binding and final. By the entrant’s Repost, the entrant is accepting these Official Rules and the grant of rights in favor of Sponsor with respect to entrant’s Repost pursuant to the terms indicated in these Official Rules.  Additionally, entrants must sign and return a written document as requested by Sponsor to perfect such grant, if necessary.  By entering, entrant agrees to be notified via X direct messaging, or by using the contact information provided by the entrant during prize claim process by the Sponsor and/or GMR for the purposes of the administration of this Promotion. All federal, state/provincial/territorial/municipal, and local laws and regulations apply. By participating, entrant agrees to release and hold harmless the Released Parties and X Corp. from any injury, loss or damage to person, including death or property damage due in-whole or in-part, directly or indirectly to the acceptance, use, or misuse of a prize, participation in any Promotion-related activity, or participation in the Promotion. The Released Parties and X Corp. are not responsible for any typographical or other error in the printing of this offer, administration of the Promotion or in the announcement of prizes, including such error as may give an erroneous indication that a prize has been won. In the event the Sponsor is prevented from continuing with this Promotion, or the integrity and/or feasibility of the Promotion is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial, territorial or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event), the Sponsor shall have the right, in its sole discretion to abbreviate, modify, suspend, cancel, or terminate the Promotion without notice or further obligation. If the Sponsor, in its discretion, elects to abbreviate the Promotion as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to randomly select the winner(s) from among all valid and eligible entries received up to the time of such Force Majeure event.

7) DISPUTES/GOVERNING LAW: To the fullest extent permitted by applicable law, all disputes concerning the Promotion and construction, interpretation, validity, effect, and enforceability of these Official Rules will be governed by the laws of the state of Washington, United States of America, without regard to conflicts of laws provisions. To the fullest extent permitted by applicable law , Entrant (i) agrees that exclusive jurisdiction over any legal action arising out of or in connection with the Promotion will be in state or federal courts located in or nearest to state of Washington, United States of America and by entering consents to such jurisdiction and venue; (ii) consents to resolve any such claims individually and without resort to class action; and (iii) agrees that all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorney’s fees or punitive, incidental, consequential, or any damages other than actual out-of-pocket expenses.

8) INTERNET: If for any reason the Internet portion of this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend this Promotion. In any such event, Sponsor, at its sole discretion, will randomly select the winner(s) from eligible, non-suspect entries received prior to the event requiring such termination, suspension or cancellation. The Released Parties and X Corp. assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties and X Corp. are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer or mobile device or gaming console related to or resulting from participation or downloading any materials in this Promotion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

9) USE OF DATA: Any personal data relating to entrants will be used solely in accordance with current data protection legislation applicable in your country of residence and in the country where the data controller is located. Entrants to the Promotion will not be added to any database list. Microsoft’s Privacy Statement located at https://privacy.microsoft.com/privacystatement will apply to this Promotion and to all information that we receive from your entry and your participation in this Promotion. Please note that by accepting these Official Rules you are also accepting the terms of the Microsoft Privacy Statement.

Entrants’ data will be used by Microsoft Corporation (One Microsoft Way, Redmond, Washington 98053 United States), by GMR Marketing LLC (5050 S. Towne Drive, New Berlin, Wisconsin 53151 United States), and by any of their representatives, employees, or third-party vendors for the use and purposes to execute the Promotion as provided in these Official Rules. Entrants may have the right to exercise their rights of access, rectification, objection, and/or cancelation of their data by emailing data@gmrmarketing.com with the subject “Data Access Request-Microsoft Final Fantasy XIV Promotion” and by visiting http://privacy.microsoft.com

10) LIABILITY: Microsoft cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Participants in this Promotion agree that Microsoft will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in this Promotion. The foregoing shall apply in the event your entry is not received or lost by Microsoft. Nothing in this clause shall limit Microsoft’s liability in respect of death or personal injury arising out of its own negligence or arising out of fraud. The provisions of this Section shall apply to the maximum extent permitted by applicable law.

11) OTHER: No correspondence will be entered into regarding either this Promotion or these Official Rules. In the event of a dispute, the Sponsor’s decision shall be final and binding in all respects on all entrants. The Sponsor reserves the right to amend, modify, cancel, or withdraw this Promotion and to amend these Official Rules at any time without notice.

12) WINNERS LIST: In the event you are a prize winner, you hereby grant Microsoft, its affiliates, and GMR the right to publish your first name, last name initial, and country of residence (“Winner Information”) in online and offline media in connection with this Promotion. The Winner Information will be available for a three-month period from the date of winner’s selection by sending an email with the subject line “Winners List-Microsoft Final Fantasy XIV Promotion” to info@xboxpromotions.com.

4) SELECCIÓN DE GANADOR/PREMIO: En o alrededor del 29 de marzo de 2024, GMR seleccionará al azar a un (1) posible ganador del Gran Premio de entre todos las ingresos elegibles recibidos durante el Período de la Promoción. Todos los sorteos aleatorios se llevarán a cabo en New Berlin, Wisconsin, Estados Unidos bajo la supervisión de un representante designado del Patrocinador, cuyas decisiones son definitivas. Las probabilidades de ganar un premio dependen del número de ingresos elegibles recibidos durante el Período de la Promoción.

b) El valor aproximado de Venta al Por Menor (“ARV”, por sus siglas en inglés) del Gran Premio es de $1,319.93 USD/$1,783.87 CAD/$22,529.20 MXN.

A los efectos de estas Reglas Oficiales, el ARV de cualquier premio se estima al comienzo del Período de la Promoción. El ARV para dichos premios está sujeto a variaciones y fluctuaciones en el mercado de consumo entre la fecha en que se estima el ARV y la fecha en que se otorga el premio; no habrá compensación en efectivo ni de otro tipo por cualquier diferencia de valoración.

Las suscripciones a Xbox Game Pass Ultimate deben canjearse en microsoft.com/redeem. Se requiere tarjeta de crédito. A menos que cancele, se le cobrará la tarifa de suscripción regular vigente en ese momento cuando finalice el período promocional. Límite: 1 por persona/cuenta. Todos y cada uno de los impuestos relacionados con un premio son responsabilidad exclusiva del ganador y el Patrocinador cumplirá con los requisitos de declaración de impuestos de los Estados Unidos. Se aconseja al ganador que busque un consejo independiente con respecto a las implicaciones fiscales de aceptar un premio. Todos los demás gastos no especificados como parte de la descripción del premio son responsabilidad exclusiva del ganador.

LA ADJUDICACIÓN DEL PREMIO AL POSIBLE GANADOR PUEDE ESTAR SUJETA AL REQUISITO EXPRESO DE QUE PRESENTE AL PATROCINADOR TODA LA DOCUMENTACIÓN SOLICITADA POR EL PATROCINADOR PARA PERMITIRLE CUMPLIR CON TODAS LAS LEYES O REGLAMENTOS FEDERALES, ESTATALES, PROVINCIALES, TERRITORIALES, LOCALES U OTRAS LEYES O REGLAMENTOS DE DECLARACIÓN DE IMPUESTOS EN LOS ESTADOS UNIDOS O EN OTROS LUGARES. EN LA MEDIDA PERMITIDA POR LA LEY, TODOS LOS IMPUESTOS SOBRE LOS PREMIOS SON RESPONSABILIDAD EXCLUSIVA DEL GANADOR. La negativa por parte de cualquier participante a presentar dicha documentación o completar cualquier formulario u obligación requerida dará lugar a que dicho ganador pierda el premio.

5) GANADOR: El ganador será notificado y confirmado de la siguiente manera:

a) Ganador del Gran Premio: El posible ganador del Gran Premio será notificado a partir del 2 de abril de 2024 a través de mensaje directo en X de @Xbox (para residentes de E.U.A.), @XboxMéxico (para residentes de México) o @XboxCanada (para residentes de Canadá) a la cuenta X del posible ganador del Gran Premio utilizada para ingresar. El posible ganador del Gran Premio tendrá ciento veinte (120) horas desde el momento en que se desplegó el mensaje directo para responder al mensaje directo con sus nombres y apellidos, país, número de teléfono diurno y dirección de correo electrónico. Dentro de los dos (2) días hábiles siguientes a la recepción de la respuesta del posible ganador del Gran Premio, el posible ganador del Gran Premio será contactado por teléfono o correo electrónico al número de teléfono o dirección de correo electrónico proporcionada por el posible ganador del Gran Premio y se le pedirá que responda dentro de las veinticuatro (24) horas posteriores a la notificación para verificar la elegibilidad y proporcionar una dirección de envío (no se aceptan Apartados Postales).

i) Proceso de confirmación del ganador de los Estados Unidos: Para que un Residente de los Estados Unidos sea declarado ganador del Gran Premio, debe completar, firmar y devolver la declaración jurada presentada de elegibilidad, exoneración de responsabilidad mutuamente aceptable y liberación de publicidad, y el formulario W-9 presentado por el Servicio de Impuestos Internos del Tesoro de los Estados Unidos (los “Documentos de los Estados Unidos”) a través de Proof.com dentro de los siete (7) días calendario siguientes a la entrega de los Documentos de los Estados Unidos, o el Gran Premio se perderá en su totalidad.

ii) Proceso de Confirmación del Ganador Canadiense: Para que un residente canadiense sea declarado ganador del Gran Premio, primero debe responder correctamente a una pregunta de prueba de habilidades matemáticas por tiempo limitado sin ayuda y sin asistencia mecánica o de otro tipo, y haber cumplido en su totalidad con estas Reglas Oficiales. La pregunta de prueba de habilidad será realizada por teléfono/correo electrónico dentro de las ciento veinte (120) horas siguientes a la notificación inicial de la selección. Además, para que un residente canadiense sea declarado ganador del Gran Premio, debe completar, firmar y devolver el formulario W-8 BEN del Servicio de Impuestos Internos del Tesoro del Departamento de los Estados Unidos presentado, y la declaración de elegibilidad, exoneración de responsabilidad mutuamente aceptable, y la liberación de publicidad (los "Documentos Canadienses") en línea a través de Adobe Sign dentro de los siete (7) días calendario a partir de la presentación de los Documentos Canadienses, o el Gran Premio se perderá en su totalidad.

iii) Proceso de Confirmación de Ganador Mexicano: Para que un residente mexicano sea declarado ganador del Gran Premio, debe completar, firmar, y devolver el Formulario W-8 BEN del Servicio de Impuestos Internos del Tesoro del Departamento de los Estados Unidos presentado (los “Documentos Mexicanos”) en línea a través de Adobe Sign dentro de los siete (7) días calendario a partir de la presentación de los Documentos Mexicanos, o el Gran Premio se perderá en su totalidad.

Dentro de los dos (2) días hábiles posteriores a la recepción de los Documentos de los Estados Unidos/Documentos Canadienses/Documentos Mexicanos firmados, el Patrocinador/GMR notificará al posible ganador del Gran Premio su estatus de ganador por correo electrónico o teléfono.

b) Cumplimiento del Premio: El Gran Premio se enviará dentro de aproximadamente ocho (8) semanas después de la confirmación del ganador a la dirección proporcionada por el ganador. La devolución de cualquier premio/notificación de premio como no entregable o la falta de aceptación de cualquier premio dentro del período de tiempo especificado puede resultar en la descalificación y la pérdida del premio. Si el ganador notificado no es elegible, pierde el premio o rechaza el premio, o no logra responder la pregunta de prueba de habilidades matemáticas (aplicable solo al posible ganador canadiense) , un ganador alternativo podrá ser seleccionado aleatoriamente como ganador del Gran Premio, si el tiempo y las circunstancias lo permiten. Se realizarán cinco (5) intentos para otorgar el premio. Después de estos intentos, cualquier premio no reclamado permanecerá sin otorgar.

c) Liberación de Publicidad: El ganador otorga además a Microsoft y sus afiliados el derecho de usar y publicar su nombre, apellido inicial y país de residencia en línea, en forma impresa y en cualquier otro medio en relación con la Promoción. La aceptación de un premio constituye un permiso para que el Patrocinador utilice el nombre y la imagen del ganador con fines publicitarios y promocionales sin previo aviso, revisión, aprobación o compensación adicional a menos que la ley lo prohíba.

6) TÉRMINOS ADICIONALES: Al ingresar, el participante (o, si usted es menor de edad/no ha alcanzado la mayoría de edad en su lugar de residencia, su padre o tutor legal en su nombre) acepta y está de acuerdo en acatar las Reglas Oficiales de esta Promoción y acepta que cualquier disputa con respecto a la realización de esta Promoción, interpretación de reglas o adjudicación de premio, será resuelta por el Patrocinador, cuya decisión será vinculante y definitiva. Mediante la Re-publicación del participante, el participante acepta estas Reglas Oficiales y la concesión de derechos a favor del Patrocinador con respecto a la Re-publicación del participante de conformidad con los términos indicados en estas Reglas Oficiales.  Además, los participantes deben firmar y devolver un documento escrito según lo solicitado por el Patrocinador para perfeccionar dicha subvención, si es necesario.  Al ingresar, el participante acepta ser notificado a través de mensaje directo de X, o mediante el uso de la información de contacto proporcionada por el participante durante el proceso de reclamación de premios por el Patrocinador y/o GMR para los fines de la administración de esta Promoción. Se aplican todas las leyes y reglamentos federales, estatales/provinciales/territoriales/municipales y locales. Mediante su participación, el participante acepta liberar y mantener indemne a las Partes Eximidas y a X Corp. de cualquier lesión, pérdida o daño a la persona, incluyendo la muerte o daño a la propiedad debido en su totalidad o en parte, directa o indirectamente a la aceptación, uso o mal uso de un premio, participación en cualquier actividad relacionada con la Promoción, o Participación en la Promoción. Las Partes Eximidas y X Corp. no son responsables de ningún error tipográfico u otro error en la impresión de esta oferta, la administración de la Promoción o en el anuncio de premios, incluyendo cualquier error que pueda dar una indicación errónea de que un premio ha sido ganado. En caso de que el Patrocinador se vea impedido de continuar con esta Promoción o en caso de que la integridad y/o viabilidad de la Promoción se vea afectada a causa de cualquier incidente, incluyendo, entre otros,  incendios, inundaciones, epidemias, terremotos, explosiones, conflictos laborales o huelgas, casos fortuitos, actos de vandalismo, fallas satelitales o de algún equipo, revueltas o disturbios civiles, guerra (declarada o no), amenazas o actividades terroristas o cualquier ley federal, estatal, provinicial o del gobierno local, mandato o regulación, sentencia de cualquier tribunal o jurisdicción u otra causa fuera del control razonable del Patrocinador (cada una considerada un incidente de “Fuerza Mayor”), el Patrocinador tendrá el derecho, a su entera discreción, de acortar, modificar, suspender, cancelar o terminar la Promoción sin previo aviso u obligación adicional. Si el Patrocinador, a su discreción, opta por acortar la Promoción como resultado de un incidente de fuerza mayor, el Patrocinador se reserva el derecho, aunque no tendrá ninguna obligación, de seleccionar al ganador o ganadores de forma aleatoria de entre todos los ingresos válidos recibidos hasta el momento en el que se presente dicho incidente de fuerza mayor.

7) DISPUTAS/LEGISLACIÓN APLICABLE: En la máxima medida permitida por la ley aplicable, todas las disputas relativas a la Promoción y la interpretación, validez, efecto y aplicabilidad de estas Reglas Oficiales se regirán por las leyes del estado de Washington, Estados Unidos de América, sin tener en cuenta los conflictos de disposiciones legales. En la máxima medida permitida por la ley aplicable, el Participante (i) acepta que la jurisdicción exclusiva sobre cualquier acción legal que surja de o esté relacionada con la Promoción será en tribunales estatales o federales ubicados en o más cercanos al estado de Washington, Estados Unidos de América y al ingresar está de acuerdo con tal jurisdicción y lugar; (ii) está de acuerdo en resolver cualquiera de tales reclamaciones individualmente y sin recurrir a una acción colectiva; y (iii) acepta que todas las reclamaciones, sentencias y laudos se limitarán a los costos reales de bolsillo incurridos, pero en ningún caso incluyen honorarios de abogado o daños punitivos, incidentales, consecuentes o cualquier otro daño que no sea gastos reales de bolsillo.

8) INTERNET: Si por alguna circunstancia la parte relativa a Internet de esta Promoción no se ejecutara de acuerdo con lo previsto, incluyendo por una infección a causa de virus informáticos, fallas, manipulación, intervención no autorizada, fraude, fallas técnicas o por cualquier otra causa más allá del control del Patrocinador que corrompa o afecte la gestión, la seguridad, la imparcialidad, la integridad o conducta apropiada de esta Promoción, el Patrocinador se reserva el derecho, a su entera discreción, de descalificar a cualquier individuo que altere el proceso de ingreso, y de cancelar, finalizar, modificar o suspender esta Promoción. En cualquier evento de este tipo, el Patrocinador, a su entera discreción, seleccionará aleatoriamente al ganador o ganadores de entre los ingresos elegibles y no sospechosos recibidos antes del evento que requiera dicha terminación, suspensión o cancelación. Las Partes Eximidas y X Corp.no asumirán responsabilidad alguna por ningún error, omisión, interrupción, eliminación, defecto, retraso en la operación o transmisión, fallo en la línea de comunicaciones, robo o destrucción o acceso no autorizado a, o alteración de, los ingresos. Las Partes Eximidas y X Corp.no son responsables de ningún problema o mal funcionamiento técnico de ninguna red telefónica o líneas, sistemas informáticos en línea, servidores o proveedores, equipos informáticos, etc. software, fallo de cualquier correo electrónico o ingreso dirigidos al Patrocinador debido a problemas técnicos o congestión de tráfico en Internet o en cualquier sitio Web, o cualquier combinación de los mismos, incluyendo cualquier lesión o daño a la computadora o dispositivo móvil o consola de juegos del participante o de cualquier otra persona con relación o que resulte de la participación o de la descarga de cualquier material en esta Promoción. ADVERTENCIA: CUALQUIER INTENTO DE DAÑAR DELIBERADAMENTE CUALQUIER SITIO WEB O DE OBSTACULIZAR EL EJERCICIO LEGÍTIMO DE ESTA PROMOCIÓN PUEDE CONSTITUIR UNA VIOLACIÓN DE LAS LEYES PENALES Y CIVILES Y, EN CASO DE QUE SE PRODUZCA TAL INTENTO, EL PATROCINADOR SE RESERVA EL DERECHO DE SOLICITAR UNA INDEMNIZACIÓN POR DAÑOS Y PERJUICIOS HASTA EL MÁXIMO GRADO PERMITIDO POR LA LEY.

9) USO DE LOS DATOS: Los datos personales relativos a los participantes se utilizarán únicamente de conformidad con la legislación vigente en materia de protección de datos aplicable en su país de residencia y en el país donde se encuentra el responsable del tratamiento. Los participantes en la Promoción no se agregarán a ninguna lista de bases de datos. La Declaración de Privacidad de Microsoft en https://privacy.microsoft.com/privacystatement se aplicará a esta Promoción y a toda la información que recibamos de su ingreso y su participación en esta Promoción. Tenga en cuenta que al aceptar estas Reglas Oficiales, también acepta los términos de la Declaración de Privacidad de Microsoft.

10) RESPONSABILIDAD: Microsoft no puede garantizar el rendimiento de terceros y no será responsable de ningún acto o incumplimiento por parte de un tercero. Los participantes en esta Promoción aceptan que Microsoft no tendrá responsabilidad alguna por lesiones, pérdidas, costos, daños o decepciones de ningún tipo que resulten en su totalidad o en parte, directa o indirectamente de la aceptación, el uso indebido o el uso de un premio, o de la participación en esta Promoción. Lo anterior se aplicará en caso de que Microsoft no reciba o pierda su ingreso. Nada de lo dispuesto en esta cláusula limitará la responsabilidad de Microsoft en caso de muerte o lesiones personales derivadas de su propia negligencia o derivadas de fraude. Las disposiciones de esta Sección se aplicarán en la medida máxima permitida por la ley aplicable.

11) OTROS: No se ingresará correspondencia alguna con respecto a esta Promoción o a estas Reglas Oficiales. En caso de disputa, la decisión del Patrocinador será definitiva y vinculante en todos los aspectos para todos los participantes. El Patrocinador se reserva el derecho de enmendar, modificar, cancelar o retirar esta Promoción y de modificar estas Reglas Oficiales en cualquier momento sin previo aviso.

12) LISTA DE GANADORES: En el caso de que usted sea un ganador del premio, usted otorga a Microsoft, sus afiliados y GMR el derecho de publicar su nombre, inicial de apellido y país de residencia (“Información del Ganador”) en medios en línea y fuera de línea en relación con esta Promoción. La información del ganador estará disponible durante un período de tres meses a partir de la fecha de selección del ganador enviando un correo electrónico con el asunto”"Lista de ganadores - Promoción de Microsoft Final Fantasy XIV” a info@xboxpromotions.com.
